DriveDeduct Terms of Service

These Terms are an agreement between you and Magramane LLC ("we", "us"), the maker of the DriveDeduct mobile app and related services (the "Service"). By creating an account, starting a subscription or using the Service, you agree to these Terms and to our Privacy Policy.

## 1. Who can use DriveDeduct You must be at least 18 years old and live in the United States. You are responsible for keeping access to your phone and email account secure.

## 2. What DriveDeduct does, and does not do DriveDeduct helps you record mileage, expenses and related information. It shows estimates (for example mileage deductions, a comparison of the standard mileage and actual expense methods, estimated tax and state notes) for planning only.

DriveDeduct is not a tax preparer and does not provide tax, legal, accounting or financial advice. It does not prepare, sign or file tax returns or make payments for you.
Tax rules change and depend on your situation. Confirm everything with a qualified tax professional or the IRS before you rely on it.
We do not guarantee that the IRS, any state or any other party will accept your records, or the outcome of any audit, examination or dispute.

## 3. Your responsibilities - You are responsible for the accuracy and completeness of your records and for your tax filings and payments. Review every drive, category, expense and estimate before using it. - GPS accuracy. Mileage measured by your phone depends on the device, settings and signal and may be inaccurate or incomplete. Keep odometer readings and other support. - AI features. Reading VINs, odometers and receipts from photos uses automated analysis that can make mistakes. You must check the values before saving them. - Safety. Do not use the app while driving. Start and stop Trips only while safely parked and obey all traffic laws. You are solely responsible for how and when you use your phone. - Use the Service lawfully and only for your own records (or, for fleet features, records you are authorized to keep).

## 4. Records and signatures Records are designed to be append-only: corrections are added as new entries and originals are kept. Your in-app signature and one-tap confirmations are your statement that the records are accurate to the best of your knowledge. ## 5. Subscription DriveDeduct costs $2.99 per month [plus applicable taxes], billed through the Apple App Store or Google Play. Subscriptions renew automatically until you cancel in your store account settings at least 24 hours before renewal. Refunds are handled by Apple or Google under their policies. We may change the price with advance notice as the stores require. [Free trial terms, if any.]

## 6. Your data Your records belong to you. We use them only to provide the Service, as described in the Privacy Policy. You can export your records (CSV) and delete your account in the app at any time. We are not responsible for data that exists only on your phone and is lost with the phone, or if you chose not to back up.

## 7. Third-party services and marks The Service relies on third parties (for example cloud hosting, email delivery, the NHTSA vehicle database and an AI provider for photo reading). DriveDeduct is not affiliated with or endorsed by the IRS, any government agency, DoorDash, Uber, Amazon, Instacart, Grubhub, Walmart or any other platform; their names are used only to describe compatibility.

## 8. Disclaimer of warranties THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

## 9. Limitation of liability TO THE FULLEST EXTENT PERMITTED BY LAW, MAGRAMANE LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY TAXES, PENALTIES, INTEREST, LOST DEDUCTIONS OR LOST PROFITS, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM [OR $50, IF GREATER]. Some states do not allow some of these limits, so they may not apply to you.

## 10. Indemnity You agree to indemnify Magramane LLC against claims arising from your misuse of the Service, your records or filings, or your violation of these Terms or the law, including use while driving.

## 11. Changes and termination We may update these Terms; material changes will be shown in the app and you will be asked to accept them. You may stop using the Service at any time. We may suspend accounts that violate these Terms.

## 12. Governing law and disputes These Terms are governed by the laws of [STATE where Magramane LLC is organized]. [Attorney: choose courts vs. individual arbitration with class-action waiver, and small-claims carve-out.]
